The Legal Aspects of a Secret Invention

Abstract. The institution of a secret invention does not solely stem from patent law by its nature; rather, it constitutes a unique institution at the intersection of patent law and militarization, specifically, national security law [1]. The regulation of the institution of a secret invention differs significantly from the regulation of ordinary inventions, which is evident, among other things, in the special procedure for recognizing an invention as secret, the specific entities eligible to apply for a patent on a secret invention, and the authorities involved in this procedure.
